These Terms and Conditions set out the basis on which we provide waste disposal and collection services in Kentish Town and surrounding areas. By making a booking, using our waste collection services or allowing us access to your premises, you agree to be bound by these Terms and Conditions.
Please read these Terms and Conditions carefully before placing an order for any waste disposal service. If you do not agree with any part of these terms, you should not proceed with a booking or use our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business or organisation requesting waste disposal or related services.
Services means any waste collection, transportation, clearance, removal, recycling or disposal services we agree to provide.
Premises means the property, land or location where the Services are to be provided.
Waste means the materials, items or substances presented by the Customer for collection and disposal, subject to applicable waste regulations.
We, us and our refer to the service provider operating under these Terms and Conditions.
We provide waste disposal and collection services, including but not limited to household waste removal, bulky item collection, commercial waste collection and recycling services, within Kentish Town and nearby locations.
The precise scope of the Services will be as agreed with you at the time of booking, including the type and approximate volume of Waste, the collection address, and the agreed date and time window for service.
We reserve the right to refuse to collect certain materials where they are not accurately described at the time of booking, where they are classed as hazardous or prohibited under waste regulations, or where access to the Premises is unsafe.
3.1 Bookings may be made by telephone or by any booking method we make available from time to time. When making a booking you must provide accurate and complete information, including:
a. Your full name and contact details.
b. The collection address in Kentish Town or the surrounding area.
c. A clear description of the Waste to be collected.
d. Any access restrictions, parking limitations or other relevant details.
3.2 Your booking constitutes an offer to purchase Services in accordance with these Terms and Conditions. We will confirm acceptance of your booking by issuing a confirmation by your chosen method of communication. The contract between you and us is formed when we send this confirmation.
3.3 We may, at our discretion, refuse a booking where the requested service falls outside our normal service area, where the Waste to be collected is not suitable for our service, or where we reasonably believe the booking is fraudulent or made in bad faith.
4.1 We will use reasonable efforts to attend the Premises on the agreed date and within any time window we may have indicated. However, all times are estimates and are subject to traffic, access conditions and operational factors. Time is not of the essence in relation to attendance or completion of the Services.
4.2 You are responsible for ensuring that we have safe, lawful and reasonable access to the Premises at the agreed time, including suitable parking or loading space for our vehicle. Any permits or permissions required for parking or access must be obtained by you in advance unless we have explicitly agreed otherwise.
4.3 If we are unable to access the Premises or collect the Waste due to circumstances within your control, including but not limited to absence of a responsible person to grant access, locked gates, failure to obtain parking permits, or inaccurate address details, we may charge a failed collection fee or treat the booking as cancelled by you.
5.1 You are responsible for accurately describing the Waste at the time of booking, including approximate volume, type of materials, and any special handling requirements.
5.2 We do not accept certain types of Waste, including but not limited to:
a. Hazardous or dangerous materials such as asbestos, chemicals, solvents, oils, gas cylinders and medical waste.
b. Pressurised containers or explosive materials.
c. Any Waste that we are not legally permitted to transport or dispose of.
5.3 If on arrival we find that the Waste differs substantially from that described, is of a hazardous nature, or cannot legally be collected or disposed of, we may refuse all or part of the collection, adjust the price accordingly or cancel the booking. Any additional costs such as call-out charges may apply.
5.4 You warrant that you have full authority to allow us to remove the Waste from the Premises and that the Waste does not belong to any third party whose consent has not been obtained.
6.1 Prices for our Services will be provided at the time of booking based on the information you supply and our current tariffs. All prices are quoted in pounds sterling and may be subject to applicable taxes.
6.2 The final price may vary where the actual quantity or type of Waste differs from that described at the time of booking, or where access to the Premises requires additional labour or time. We will inform you of any change in price and seek your agreement before proceeding where this is reasonably practicable.
6.3 Payment terms will be confirmed at booking. We may require payment in full at the time of booking, payment on collection, or invoice terms for approved business customers.
6.4 Accepted payment methods may include debit or credit card, bank transfer, or other methods we make available. You agree to provide valid payment details and authorise us to charge the agreed amounts.
6.5 Where payment is not received by the due date, we reserve the right to suspend further Services, charge reasonable late payment interest and recover any costs incurred in pursuing outstanding sums.
7.1 You may cancel or amend a booking by contacting us directly during our normal office hours.
7.2 If you cancel a booking more than 24 hours before the agreed collection time, no cancellation fee will usually apply unless otherwise stated at the time of booking.
7.3 If you cancel less than 24 hours before the agreed collection time, or if we attend the Premises and are unable to carry out the collection due to reasons within your control, we may charge a cancellation fee or a failed collection fee to cover our costs.
7.4 We may cancel or reschedule a booking where necessary due to operational reasons, staff illness, vehicle breakdown, adverse weather, or circumstances beyond our reasonable control. Where possible, we will provide reasonable notice and offer an alternative date or refund any fees already paid for Services not provided.
8.1 You agree to:
a. Provide accurate information when booking and update us if anything changes.
b. Ensure the Waste is accessible, segregated where required, and presented in a safe manner.
c. Comply with all applicable laws and local requirements relating to waste storage and presentation.
d. Provide safe and appropriate access to the Premises for our staff and vehicles.
8.2 You must not present for collection any materials that are illegal to possess or dispose of, or any Waste that you do not have permission to remove.
9.1 We will provide the Services with reasonable care and skill and in accordance with applicable UK waste management regulations.
9.2 We will ensure that Waste collected is transported and disposed of at authorised facilities and in compliance with duty of care obligations under relevant legislation.
9.3 We will take reasonable steps to ensure that our vehicles, equipment and staff operate in a safe and professional manner when attending your Premises.
10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
10.2 Subject to the above, we will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, business interruption, or loss of data, arising out of or in connection with the provision of the Services.
10.3 Our total liability to you in respect of all losses arising under or in connection with the Services and these Terms and Conditions, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable by you for the specific Services giving rise to the claim.
10.4 You are responsible for removing or protecting any items that could be damaged during the collection process. While we will act with reasonable care, we are not liable for normal wear and tear, minor scuffs to paintwork, or damage arising from pre-existing defects or structural weaknesses at the Premises.
10.5 We shall not be liable for any delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including severe weather, road closures, accidents, strikes, acts of government or other force majeure events.
11.1 We operate in accordance with relevant UK waste management laws and regulations, including licensing, duty of care requirements and environmental obligations.
11.2 By engaging our Services, you acknowledge that we may need to collect, record and retain certain information about your Waste and its disposal to comply with legal requirements.
11.3 We reserve the right to refuse to handle any Waste where we reasonably believe that accepting it would breach applicable regulations or our licence conditions.
11.4 You agree to provide any information we reasonably require to comply with legal and regulatory obligations, and you warrant that such information is accurate and not misleading.
12.1 We maintain appropriate insurance cover in respect of our operations, including public liability insurance, in accordance with industry practice.
12.2 It is your responsibility to ensure that you have adequate insurance in place for your own property and belongings at the Premises. We do not provide insurance for your property or for any items not designated as Waste.
13.1 We will collect and process personal information you provide to us for the purposes of handling your booking, providing the Services, processing payments and complying with legal obligations.
13.2 We will handle your personal information in accordance with applicable data protection laws and will take reasonable steps to keep such information secure.
13.3 You agree that we may contact you using the details you provide in relation to your booking, the performance of the Services and any related customer service matters.
14.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as reasonably possible so that we can investigate and, where appropriate, seek to resolve the issue.
14.2 You agree to give us a reasonable opportunity to put matters right before taking any further action, including legal proceedings.
15.1 We may update these Terms and Conditions from time to time. Any changes will apply to new bookings and to ongoing Services where we notify you of the change.
15.2 The version of the Terms and Conditions in force at the time of your booking will usually apply to that booking, unless a change is required by law or regulatory authority.
16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as severed from the remaining provisions, which shall continue in full force and effect.
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided, save that if you are a consumer resident in another part of the United Kingdom you may also bring proceedings in your local courts.
18.1 These Terms and Conditions, together with any written confirmation of your booking, constitute the entire agreement between you and us in relation to the Services and supersede any prior discussions, correspondence or understandings.
18.2 You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
